Terms and conditions

These terms and conditions govern the use of the HOTIPARTS platform and the transactions concluded through it. Version: November 2026.

1. Scope

The HOTIPARTS platform is operated by Lulzim Hoti, Route du Stant 23, 1163 Etoy, Suisse, as a sole proprietorship ("HOTIPARTS" or "we"). These terms and conditions ("Terms") apply to:

  • suppliers: companies that offer spare parts from their stock through HOTIPARTS;
  • buyers: businesses and private individuals who request and purchase parts through HOTIPARTS.

A consumer is a buyer who purchases for private use, unrelated to their business or professional activity. General terms of buyers or suppliers do not apply unless HOTIPARTS has agreed to them in writing. By creating an account or sending a request, you accept these Terms.

2. Role of HOTIPARTS

HOTIPARTS acts as a commission agent (commissionnaire) within the meaning of Art. 425 et seq. of the Swiss Code of Obligations (CO): we sell the parts in our own name but on behalf of the supplier. The buyer's sole contracting party is therefore HOTIPARTS, which collects the price and pays the supplier the amount due to them.

HOTIPARTS holds no stock and does not physically inspect the parts. Part information (part number, description, condition, compatibility, photos) is provided by the suppliers, who are responsible for it. HOTIPARTS does not guarantee that a requested part is available or that an offer can be made.

The HOTIPARTS fee is included in the offer price. Suppliers pay no registration fee, subscription or listing fee.

3. Registration and verification

  • Information provided at registration must be accurate, complete and kept up to date. Private buyers must be of legal age.
  • Login details are personal and must be kept confidential. Any use of an account is attributed to its holder.
  • Suppliers are verified before they can import stock: UID register for Switzerland, VAT number via the VIES system for the EU, manual check for other countries. HOTIPARTS may request supporting documents (commercial register extract, identity document of the authorised signatory, bank details).
  • Purchases are open from the countries activated on the platform. Persons and companies established in Russia or in a country subject to sanctions by Switzerland, the European Union or the United States are excluded, as are persons appearing on a sanctions list.
  • HOTIPARTS may refuse a registration and suspend or close an account, in particular in the event of inaccurate information, a breach of these Terms or suspected abuse.

4. Supplier obligations

4.1 Information and condition of parts

The supplier warrants that it is entitled to sell the parts offered, that they are of lawful origin and that they are not counterfeit. It keeps its stock up to date (part numbers, quantities, availability) and removes parts that are no longer available without delay.

With every reply to a quote request, the supplier must certify the condition of the part: new, used or reconditioned, stating any known defect, wear, missing component or damage. The supplier is solely responsible for the accuracy of its description, its condition certification and the photos provided.

4.2 Replies and prices

The supplier replies to quote requests within 48 hours, stating the price of the part and the price of shipping to the stated destination. Its price is binding for the entire validity period of the offer made to the buyer and until that offer is paid.

The supplier agrees that HOTIPARTS sets the selling price to the buyer freely. By way of derogation from Art. 428 para. 3 CO, the difference between that price and the amount of the supplier's quote is due to HOTIPARTS as its fee.

4.3 Shipping

Once the buyer has paid, the supplier receives the delivery address and a shipping label. It ships the part within the agreed time, in suitable packaging, and enters the tracking number on the platform. For international shipments, it encloses the documents required for export and customs clearance and complies with the applicable export control and sanctions rules. It uses the buyer's address solely for this shipment.

4.4 Payout

HOTIPARTS pays the supplier the amount of its quote (part and shipping) after delivery and expiry of the buyer's inspection period, provided no claim is pending. Payment is made by bank transfer to the account registered by the supplier. If a claim is made, the payout is withheld until it is resolved.

4.5 Breaches

In the event of an inaccurate description, a non-conforming part, failure to ship, repeated failure to reply or an attempt at circumvention, HOTIPARTS may, depending on the seriousness, issue a warning, suspend quote requests, remove all or part of the published stock or exclude the supplier. Costs of return, refund or replacement caused by a breach by the supplier are borne by the supplier and may be set off against its payouts. Claims for damages are reserved.

5. Buyer obligations

  • The buyer provides accurate information (part number, quantity, delivery address). Before ordering, the buyer checks that the part fits their vehicle or machine; compatibility information is given for guidance only.
  • Requesting an offer is free and non-binding. The buyer is bound once they pay the offer.
  • The buyer checks the part immediately on delivery (part number, condition, quantity, packaging) and has any visible damage confirmed by the carrier.
  • The buyer confirms receipt or reports any problem in their account within 5 days of delivery, with photos if possible. If nothing is reported within this period, the delivery is deemed accepted and the supplier is paid.
  • Hidden defects that could not be detected during inspection must be reported as soon as they are discovered.
  • The part must be fitted properly, by a competent person.

6. Offers, prices and validity

HOTIPARTS sends the buyer an offer stating the total price for the part and shipping to the delivery address, together with the certified condition of the part. For a search carried out through the part search service, the price includes that search service.

The offer is valid for 7 days. The contract is concluded when the buyer pays the offer within this period. Once the offer has expired, a new request is required; price and availability may have changed.

Prices are stated in Swiss francs, euros or US dollars. Converted amounts are based on the rate set by HOTIPARTS at the time of the offer. If HOTIPARTS is registered for VAT, VAT is shown separately in the offer. Customs duties and import taxes are not included (section 9). Obvious pricing or input errors are reserved.

If the supplier is ultimately unable to deliver a part that has been paid for, the buyer is refunded the corresponding amount in full.

7. Payment

The buyer pays HOTIPARTS by credit or debit card and TWINT (via Stripe), by PayPal or by bank transfer. For a transfer, the buyer uses the QR-bill (Switzerland) or the IBAN and payment reference provided (other countries); the reference must be entered exactly as given. Payment must be received within the validity period of the offer. Bank charges are borne by the buyer.

Card and PayPal payments are processed by the respective providers; HOTIPARTS does not store any card data.

Protected payment: HOTIPARTS holds the amount paid and only pays it to the supplier after delivery and expiry of the inspection period. Any refund is made using the payment method used.

8. Delivery and transfer of risk

The supplier ships the part directly to the delivery address given by the buyer. Delivery times depend on the country of dispatch and the carrier and are given for guidance only.

Risk passes to the buyer when the shipment is handed over at the delivery address. Until then, the risk of loss or damage is borne by the supplier, who chooses the carrier and the packaging. Costs resulting from an incomplete or incorrect address, or from a shipment that is not collected, are borne by the buyer.

9. Customs and taxes

For delivery to a country other than the supplier's, the buyer is the importer. Unless otherwise stated in the offer, the buyer pays the customs duties, import VAT and clearance fees of their country. If the buyer refuses a shipment or does not clear it through customs, the return costs are deducted from any refund.

10. Warranty and liability

The supplier is liable for the part conforming to its description and to the condition it has certified. Claims are addressed to HOTIPARTS, which handles them with the supplier. A used part is sold in its certified condition; normal wear consistent with that condition is not a defect.

Towards business buyers, and to the extent permitted by law, warranty rights are limited, at the choice of HOTIPARTS, to replacement of the part, a price reduction or a refund against return of the part; any further claims are excluded. Mandatory warranty rights of consumers are reserved.

The liability of HOTIPARTS is limited to the amount of the fee received by HOTIPARTS on the transaction concerned. Liability for indirect or consequential damage is excluded, in particular loss of profit, downtime of a vehicle or machine, and fitting and removal costs. These limitations do not apply in cases of intent or gross negligence, nor in other cases where the law prohibits limiting liability, in particular under the Swiss Product Liability Act (PrHG) and mandatory consumer protection rules.

HOTIPARTS does not guarantee that the platform will be available at all times and free of errors.

11. Consumers resident in the European Union

Consumers resident in a member state of the European Union also have the following rights. The mandatory provisions of the law of their country of residence remain applicable.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, take physical possession of the part. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement, for example by e-mail to info@hotiparts.com or through your account. You may use the model form below, but it is not obligatory.

You must send back the part no later than 14 days after informing us of your withdrawal, to the address we provide. You bear the direct cost of returning the part. We will reimburse all payments received from you, including the standard delivery costs, no later than 14 days after receiving your withdrawal, using the payment method you used. We may withhold reimbursement until we have received the part back or you have supplied evidence of having sent it back. You are only liable for any diminished value of the part resulting from handling other than what is necessary to establish its nature, characteristics and functioning, in particular if it has been fitted or used.

Statutory guarantee

You benefit from the statutory guarantee of conformity under the law of your country of residence, generally two years from delivery. For used parts, this period is one year where your national law allows it.

Dispute resolution

The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. In the event of a dispute, please contact us first at info@hotiparts.com: we will look for an amicable solution. Your right to bring the matter before the competent courts is unaffected.

12. Prohibition of circumvention

Buyers and suppliers communicate only through HOTIPARTS. They undertake not to exchange contact details (phone, e-mail, address, website) and not to conclude directly with each other a sale of a part offered or requested on the platform. This prohibition applies for the duration of the registration and for 24 months after the last transaction.

All messages and comments are reviewed by HOTIPARTS before they are passed on, where appropriate with the help of automated tools; contact details are removed. This rule protects both sides: it keeps everyone anonymous and allows HOTIPARTS to guarantee payment.

A supplier who circumvents the platform may have their account suspended or closed and their listings removed from the site.

13. Reviews

After a transaction, the buyer may post a review. Reviews must be honest and relate to the transaction. They are anonymous for the supplier. HOTIPARTS may refuse or remove a review that breaches the law or these Terms.

14. Data protection

The processing of personal data is described in our privacy policy.

15. Changes to these Terms

HOTIPARTS may amend these Terms. The new version is published on the website and communicated to registered users by e-mail. It applies to requests sent after its publication; transactions in progress remain subject to the version in force at the time of the request.

16. Applicable law and jurisdiction

These Terms and the contracts concluded through HOTIPARTS are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the rules on conflict of laws.

The exclusive place of jurisdiction is the operator's place of business in the canton of Vaud. Mandatory places of jurisdiction are reserved, in particular those in favour of consumers: under the Swiss Civil Procedure Code or the Lugano Convention, a consumer may bring proceedings before the courts of their place of residence and may only be sued there. For consumers resident in the European Union, the mandatory provisions of the law of their country of residence remain reserved.

17. Final provisions

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain valid. In the event of discrepancies between language versions, the French version prevails, subject to mandatory consumer protection provisions.
